When you're accused of a crime in New York City, you need more than a lawyer who's merely aggressive.
You need your criminal defense lawyer to use every available resource to your advantage.
The outcome of your case depends on so many factors, including:
Criminal defense involves identifying and focusing on factors that help you, while protecting you from the ones that harm you.
Even if you're not sentenced to jail, a criminal conviction can have enormous impact on your life.
For example, when choosing between two otherwise equally qualified employees, an employer will tend to hire a person with no criminal record over a person who's been convicted.
If you're not a US citizen, a criminal conviction can affect your immigration status.
A conviction can affect your eligibility for professional licenses, public housing, and student loans.
I help my clients do everything possible within the bounds of the law to avoid the negative consequences of a conviction.
There are three possible ways for any criminal case to be resolved: 1) dismissal; 2) plea bargain; 3) trial.
Dismissal is always the best outcome, but it's not always possible. Dismissal results in no criminal record. It avoids the risk of going to trial. For legal reasons, the case gets thrown out of court.
If dismissal doesn't happen, then you need your lawyer to try to negotiate a favorable plea deal. However, what's "favorable" in a particular case depends on the combined effect of the factors described above. You're the one who decides whether a plea is favorable: you'll reject it if it's not; you'll accept if it is.
Trial is the final option. It means that a jury of fellow New Yorkers will decide your fate. No matter how strong your defense, the outcome never can be certain. It's always important to remember, though, the prosecutor faces the same uncertainty.
Preparing to win trial from Day One results in better plea offers and a better chance of dismissal. Most importantly, preparation gives you the best chance of winning trial.
I believe that the best defense results from close collaboration with my clients. I want you to fully understand the law as it applies to you. And I want to fully understand the facts from your point of view.
This approach allows me to develop a customized strategy that fits your unique situation.
