Drug Lawyer in New York City
Over the years, as a criminal lawyer in New York, I have defended hundreds of clients accused of drug crimes in many different situations, including:
- Methamphetamine Lab Wiretap investigations.
- Long-term buy operations.
- Search warrant raids.
- Car stops.
- Stop-and-frisk encounters.
- Buy-and-bust cases.
- Observation sales.
I have won acquittals at trial where:
- The client was an agent of the buyer (the "agency defense").
- Police lied about seeing the client sell drugs.
- Police framed the client.
- The undercover officer misidentified the client.
Clients accused of drug crimes sometimes have the opportunity to achieve good results other than acquittal.
"Suppression" is a good result that can be achieved in drug cases where police violate a client's rights under the Fourth and Fourteenth Amendments to the United States Constitution. For example, if police illegally arrest you in your home without a warrant, seized drugs and other evidence should be suppressed. Suppressed drugs cannot be used as evidence against you at your trial; without drug evidence, the prosecutor might not be able to get a conviction.
"Dismissal" is a favorable result that can be achieved where, for example, a prosecutor violates your right to a speedy trial under Section 30.30 of the Criminal Procedure Law.
A client who does not want to risk going to trial can sometimes avoid a felony drug conviction by successfully completing an intensive drug-treatment program, such as "DTAP" or "Judicial Diversion".
